National USPAP Update Clarification

Following additional research and clarification by the Appraiser Qualifications Board, the requirement for completing the 7 hour National USPAP Update course is based on a 24-month period and not on a credential renewal period.

The links below reflect the date of when each Kentucky Licensed/Certified Appraiser must complete the 7 hours National USPAP Update course. On March 3, 2008, New York Attorney General Andrew M. Cuomo entered into an agreement and the Kentucky Real Estate Appraisers Board decision about a response to the agreement terms.

Home Value Protection Program and Cooperation Agreement (PDF Format 63K)

It is believed by the staff and members of the Kentucky Real Estate Appraisers Board that it would be irresponsible for the Board to voice a position on the "HVCC" proposal being decided by Fannie Mae and Freddie Mac with the New York Attorney General until a final decision on the matter has been presented.  This proposal does not involve opinions or commentary from the attorney generals of other States.  Also, the State appraiser regulatory agencies are not involved because the agreement is not a part of the revision of Title XI, The Appraisal Subcommittee, or the Appraisal Foundation.
 
However, a number of individual appraisers have contacted me and suggested I should comment individually.  Therefore, attached is a letter I have written to the Office of Federal Housing Enterprise Oversight (OFHEO) in my role as a real property appraiser and a concerned professional. 
 
Please be advised that the letter is from me personally, it does not represent any position or beliefs of anyone but me.  It is not presented on behalf of the KREAB, the staff or the appraisers licensed and certified in Kentucky.
 
I do hope that all appraisers who feel something should have been worded differently or who believe something is lacking in the agreement did write the groups and let their concerns be known. 
 
It is my opinion that more more interest will be shown for individual responses than if one letter is received on behalf of a group or entity. Therefore, the more letters received from individuals, the better prospect of positive results happening.

Notice to Associate Appraisers

Pursuant to 201 KAR 30:030, all Associate Real Property Appraisers licensed after July 1, 2001 shall submit to the board two (2) complete summary appraisal reports.  Per Appraisal Subcommittee Policy Statement 10 revision, the Board shall immediate require all applicant submit a log of work experience.  From that log the Board staff will select appraisal reports for each level of experience review.

The reports selected from the log will be reviewed to verify minimum USPAP compliance and use of acceptable appraisal practices, methods and techniques.  Any deficiencies will be noted so future appraisals will be compliant.  If it is believed necessary to establish the competency of the associate, the board shall request additional reports from the log for review.

Anyone who requests education approval for a course not approved by the KREAB must submit a course description, course time outline, and if taken outside the State of Kentucky, a completion certificate indicating approval by the appraiser regulatory agency in the State where the course was offered.

IMPORTANT
Read this message from Freddie Mac!! 

Freddie Mac released the attached memorandum on November 15, 2007.  The memorandum Bulletin includes advice for "appraiser responsibilities when performing an appraisal."  Appraisers should pay particular attention to the advice on providing a "description" of the prevalence and impact of financing assistance.  
 
Also, there is advice provided for "seller responsibilities for appraisals."  Note the term "seller" in this memorandum identifies the individual or group who sells mortgages to Freddie Mac, not the property seller.  The advisory is clear and concise in explaining that Freddie Mac "holds the Seller accountable for the quality, integrity and accuracy of the appraisal."
